People in business know very well how competitive and often cruel is the environment in the 'free enterprise' world we live in. They also know that in their everyday activities they experience stresses endangering their psychosomatic well being.
Our competitive legal system prompts people and organizations towards disputes of the 'I win-you lose' type. Or even, 'If I am to survive I have to eliminate the other'.
This means:
- Pushing everybody to extreme positions.
- A feeling that one doesn't have control over the situation, but the legal system through its representatives.
- Waist of valuable time.
- Deterioration or even destruction of business relations.
- Expensive, never ending procedures.
- Some to have the upper hand through the use of loopholes in the legal system.
- The winner to get eventually a 'pyrrian win' in financial and psychological terms.
- Negative publicity and many more.
All of these can be avoided with the use of mediation and perhaps an eventual arbitration.
It can be said that mediation is not a choice to be regretted. One has the feeling that one did ones best to avoid conflict and in any case relations improve after mediation is completed.
